TERMS & CONDITIONS

1. FITNESS SPACE TERMS & CONDITIONS
Fitness Space Ascot is owned and managed by Fitness Space (Ascot) Ltd.

It is the franchise owner that is responsible for payments processed and the delivery of services. Payments and services sold are not the responsibility of Fitness Space Franchise Ltd.

2. ACCEPTANCE OF MEMBERSHIP
The decision to accept the application of a potential member shall be at the sole discretion of Fitness Space. Fitness Space reserves the right to verify,or require proof of all information given in order to obtain membership and any fraudulent or wrongful information given in order to obtain such membership could result in the cancellation of all membership rights and lead to the repayment of all monies due to Fitness Space. If the membership application is accepted by Fitness Space, membership of Fitness Space by the applicant shall commence as stated in the agreement.
The acceptance of an application for membership of Fitness Space shall constitute a legally binding agreement between the member and the studio. The member hereby agrees also to be bound by the Studio Rules and Procedures, Health commitment statement a copy of which can be provided by asking at Reception.

3. LIMITATION OF LIABILITY
The member acknowledges that Fitness Spaces obligations and liabilities in respect of Fitness Space are defined in this agreement and/or within the Regulations Applicable to All Users.
The member is responsible for the consequences of any use of any of the facilities of Fitness Space. Fitness Space will not be liable for any indirect or consequential loss, damage, costs, expenses, theft or damage to property, whether arising under contract, or otherwise.

4. PHYSICAL HEALTH OF MEMBER
The member warrants and also represents that he/she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition.
Before using Fitness Space, the member must first read a Health Commitment Statement, COVID procedure and Lone training guidance provided by Fitness Space under its obligations as a member of the Fitness Industry Association.

5. MEMBERSHIP
Memberships are categorised by both membership type and terms.
Membership types and their entitlements are covered in the Studio Rules.
Membership Terms are covered in Membership Charges and Payment Options.
Other categories of membership shall be stipulated by Fitness Space from time to time. Services included in membership come on a monthly use or lose basis unless otherwise stipulated. e.g Buy PT membership free offer is 1 PT per month and if not used the session credit is lost.

6. MEMBERSHIP CHARGES & PAYMENT OPTIONS
All members are liable to pay all upfront or monthly membership fees irrespective of actual usage of Fitness Space facilities.
Members may elect to pay their membership fees in monthly deferred payments or in full.
Monthly deferred payment plans are subject to rolling contract terms (auto renew) with a defined minimum period.
If paying monthly, the contract is for a minimum of (the period) depending on membership selected. After the minimum period, the member will be given the opportunity to renew their membership for a further fixed period of 1 month, and after each fixed period thereafter. Note that the period is defined by the name of membership for example: i. A Just Gym 6m memberships denotes the commitment to a just gym membership for a minimum six-monthly payments period, via monthly deferred payment plan, before continuing on a monthly rolling commitment. ii. Flexi memberships are defined as a rolling membership with the next full monthly payment due as notice of cancellation.iii. Upfront payments cover the full term of membership and are non-refundable. Note that continuance of monthly payments made to Fitness Space at the end of the minimum period, and any fixed periods thereafter, shall be deemed to constitute renewal of this Membership Agreement for a further fixed period of 1 month at the prevailing rate until written notice is received by Fitness Space and/or the Collections agency at least 1 calendar month prior to proposed termination date. Fitness Space reserves the right to increase membership fees on a yearly basis.

7. CANCELLATION AND CAUSES FOR EARLY TERMINATION
The following reasons may be acceptable to Fitness Space subject to formal agreement for early termination. Termination requests will only be accepted and applied from the date of written correspondence received by the Studio or the Collections agency. Illness or Injury: Letter from GP or referring Doctor required. Re-Location: Proof of relocation out of the area is required. Bankruptcy: proof required. Written correspondence must be addressed to ascot@fitnessspace.com.
To cancel a monthly deferred payment membership an email must be sent to ascot@fitnessspace.com requesting to do so. If the minimum term has surpassed, then one further full payment will be taken from the date of this correspondence.
If early termination criteria is not met then monthly deferred payment memberships are subject to one full payments notice from the date of the cancellation request post minimum term.
Annual upfront membership will run until the anniversary date. This membership is non-refundable and will not renew without payment. Upfront memberships are non-refundable.
All credits for services expire without active membership.

8. EXPULSION OF MEMBERS/GUESTS OR TERMINATION OF MEMBERSHIP BY FITNESS SPACE
Fitness Space may expel members/guests or may terminate the membership of any member:
without notice and with immediate effect if the members conduct, whether or not such conduct is the subject of a complaint by another member or group of members, is such that in the reasonable opinion of Fitness Space, it may be injurious to the character, name or interests of the Studio or is such that it renders the member unfit to associate with other members of Fitness Space.
By notice in writing if any part of the annual membership fee or monthly membership charge which is due and payable remains unpaid thirty days after the due date for payment.
Lapses in membership payment will incur an Administration charge.
A member whose membership is terminated by Fitness Space, shall forfeit all privileges of membership with immediate effect without an entitlement to any claim for any refund of their product fee or annual or monthly deferred membership fee.

9. STUDIO FACILITIES
Certain categories of membership do not include all of Fitness Spaces services and facilities. Services and facilities not so included may be provided at an additional charge at Fitness Spaces discretion.
Members who fail to attend pre-booked activities may be charged the full standard fee for the activity in question.
Fitness Space reserves the right to make reasonable alterations to the type of facilities provided without notice and Fitness Space shall not be liable for any inconvenience caused by building works and for the provision of essential maintenance services that occur for 14 days or less, due to matters beyond our control or improvement works.

10. HOURS OF OPENING
Information in relation to Fitness Spaces normal hours of operation and the opening hours of the facilities are available from Fitness Space upon request. Such hours may be lengthened or shortened at the absolute discretion of Fitness Space with or without any prior notice being given to members. Fitness Space shall endeavour to give members reasonable notice of change to such hours.
On occasions when necessary maintenance is required, Fitness Space, or parts thereof, may be closed. Any refund given as a result of closure will only be made at the sole discretion of the Director or Manager. There may be hours that the gym is open but unmanned.

11. NOTICE AND MEMBERSHIP CORRESPONDENCE
All membership related correspondence, including cancellation and freeze requests, must be sent to the email Ascot@fitnessspace.com. The email will be time stamped. The studio will endeavour to respond within 5 working days.

12. ADDITIONAL PAID SERVICES including personal training are available and payment is due in advance and is not refundable. Services sold by Fitness Space will be delivered by Fitness Space and not individuals. Credits that are discounted by membership are only valid with membership. Additional service payments are non-refundable. Validity of credits will be notified where time limits are applicable.

FITNESS SPACE STUDIO RULES

The acceptance of an application for membership of Fitness Space shall constitute a legally binding agreement between the member and the studio. The member hereby agrees also to be bound by these studio rules, a copy of which can be provided by asking at reception. Studio rules apply to all persons accessing Fitness Space facilities and/or products and services.

Behaviour
If any member shall cause a nuisance or annoyance to other members, guests or staff, or misuse the studio facilities, or generally behave inappropriately, the studio reserves the right to refuse admission or suspend or terminate membership. Abusive language, threatening or violent behaviour will not be tolerated.
All minors must be accompanied by an adult at all times.
Permission must be sought for any camera usage.

Booking
Classes may be booked up to 8 days in advance via the App/ Member booking system. Members are responsible for cancelling their class if they can no longer attend, failure to do so without 24 hours notice may result in a ban on booking future classes. Classes do have a waiting list option, you will be notified by email if a place becomes available, if you have been successful in gaining a reserved place you will be notified by email. Members are also responsible for cancelling any sessions with their Fitness Coach.

Personal Training
Members are responsible for booking their own personal training sessions with their Fitness Coach, or via the app should you need to cancel your session, you should do so with at least 24 hours notice. Less than 24 hours may result in you forfeiting the session and incurring a charge. All personal training must be paid for before the session takes place and is non-refundable. Personal training is with Fitness Space not a specified coach.

All credits for services expire without active membership.

Changing Rooms
Any minor under the age of 16 must be accompanied by their parent/ guardian when entering the changing room. They must not use the changing room of the opposite sex if over the age of 8 years old. Changing rooms are checked regularly for cleanliness by a member of staff .

Classes
All class attendees should arrive to the studio at least 5 minutes before their class is due to commence. Any attempted late entries maybe rejected or their class space reallocated by the instructor. Please respect other class attendees when entering and using the studio. Class attendees must also be respectful to any equipment used during the session and should use the cleaning products available at the end of the session.

Comment and Complaints
Please refer any comments or complaints to a member of staff, any written complaints must be addressed to the General Manager.


Fitness Areas
Access to fitness areas may be limited in the event of classes or pre-organised sessions. Club approved footwear and clothing must be worn at all times.

Guest Lockers
Members and guests are asked to store personal belongings in the lockers provided. Lockers are provided on a daily basis only, any items left overnight will be removed and treated as lost property. Belongings are left at owners risk.

Lost Property
All lost property found on the premises should be handed in to reception. Items whose ownership cannot be identified will be stored by the club for 6 weeks and then donated to charity.

Opening Hours
The clubs opening hours, are displayed within the facility. Members must ensure they are ready to leave the facility at the stated closing time, they should leave adequate time if showering and dressing is required. A member of staff will open the club at the time stated within the opening hours.

Guests must book in with a member in advance and they should be accompanied by the member at all times and must pay on entry. Members should not leave the premises before their guest. All guests must complete and sign an HCS

Safety and Hygiene
Before using the facilities. The club
reserves the right to refuse admission to a guest for reasons for health and safety or if the guest has previously not complied with club rules. It is your responsibility to ensure any equipment you use is wiped down and clean thoroughly. You must always ensure you leave equipment in a safe position ready for the next use. It is your responsibility to store equipment safely and re-rack any weights used.

Health Commitment Statement
Upon joining the club all new members are required to complete and sign a HCS. The purpose of this is to ensure that the clubs staff are fully informed of any physical or medical condition which could affect the members ability or suitability to take part in physical activities.

Only if the clubs staff are fully informed, can they assess the members health and fitness level and prepare an appropriate exercise program. The club strongly recommends that all members seek medical advice before commencing a new exercise program and the club reserves the right to request a doctors certificate and to reject a membership application if a satisfactory doctors certificate is not received by the club.

In the interest of safety and hygiene, no crockery or glass should be brought on to the premises. No food or alcoholic drinks should be consumed on the premises. No pets will be allowed to enter the club, with the exception of guide dogs. Cleaning products are available within the club, these should be used by the members and guests as necessary during their sessions. Fire exits, which are clearly marked, are there in the interests of safety, they must not be interfered with for any reason. In the event of an emergency evacuation, members and guests must immediately make their own way to the nearest available exit.

Unmanned hours
The Club is under recorded video surveillance and all key member usage is logged.
You may not bring in guests at any time without prior written consent of the Club. Furthermore, if this policy is violated, at the sole discretion of the Club, you may be charged a guest fee and/or your membership suspended or terminated with the full membership fee for the remainder of the Commitment Period declared due and payable and a penalty of £125.

Members must read all Health and Safety notices displayed in the Club and comply with their recommendations at all times. In particular you must observe all instructions regarding the safe and proper use of each item of fitness equipment in the Club, recognising that at times the Club will be unsupervised and that at such times you should not use any item of fitness equipment with which you are not familiar or in respect of which you have not previously received induction training from a qualified member of staff at the Club.

You are responsible for understanding how to operate the panic alarms and agree to use them only in case of an emergency. You are responsible for familiarising yourself with the safety and security systems in your Club.

You are hereby required to use the safety features of the equipment. If you are unsure how to use a machine, you should not use it until you have obtained instructions from the staff or personal trainers. I acknowledge that Fitness Space recognise the importance of every new member undergoing induction training in the safe and proper use of the fitness equipment in the Club. I am aware that Fitness Space has recommended that as a new member I receive induction training. If I decide that I do not wish to undertake induction training I will seek advice from a member of staff if I am unfamiliar with a particular piece of equipment or type of exercise. Further I accept that I have opted out of the induction training in the knowledge that this is an UNSUPERVISED FITNESS CLUB and I undertake to consult staff on an ongoing basis in relation to the safe use of the Club's facilities and equipment. I acknowledge that this is at times an UNSUPERVISED FITNESS CLUB and I assume all risks associated with using exercise equipment and exercising alone without the aide and presence of club staff on the premises.

Terms & Conditions of Membership Agreement
All members agree to abide by the terms & conditions of their membership which are available from the General Manager, when joining the club the member approves the terms & conditions online and/or via a signed paper form

3. We will take all reasonable steps to make
sure that our staff are qualified to the fitness
industry standards as set out by the Register of Exercise Professionals.
4. If you tell us that you have a disability which puts you at a substantial disadvantage in accessing our equipment and facilities, we will consider what adjustments, if any, are reasonable for us to make.

Your Commitment To Us:
1. You should not exercise beyond your own abilities. If you know or are concerned that you have a medical condition which might interfere with you exercising safely, before you use our equipment and facilities you should get advice from a relevant medical professional and follow that advice.
2. You should make yourself aware of any rules and instructions, including warning notices. Exercise carries its own risks. You should not carry out any activities which you have been told are not suitable for you.
3. You should let us know immediately if you feel ill when using our equipment or facilities. Our staff members are not qualified doctors, but there will be a person available who has had first aid training.
4. If you have a disability, you must follow
any reasonable instructions to allow you
to exercise safely.

what adjustments, if any, are reasonable for us to make.

1. However motivated you may be, do not exercise beyond your own abilities. If you know or are concerned that you have a

2. It is important that you exercise in a safe environment. If you are using any equipment, make yourself aware of any rules and

4. We have taken all reasonable steps to cater for people with disabilities. Follow any reasonable instructions to allow you to

Your commitment to us and other gym users
1. Do not enter the gym if you or anyone in your household has coronavirus symptoms.
2. By entering the gym you accept that even though we have put in place the government guidelines, you are still at risk of
getting coronavirus.Make yourself aware of the government guidelines published online at www.gov.uk about protecting
yourself and others from coronavirus, and follow them.
3. Make yourself aware of the changes we have made and any rules we ask you to follow, and follow them.
Relating to exercise

Member Rules on Safety & Hygiene.

By visiting Fitness Space you are agreeing to the following rules
You must:

Make yourself familiar with all safety and cleaning procedures. Failure to follow these may result in a temporary or permanent ban from the gym

Not visit the gym if you are showing any symptoms of Covid-19 or live with anyone showing symptoms or who has the virus

Follow the social distancing guidelines at all times while in the gym

Wash or sanitise your hands thoroughly on entering the gym and regularly while in the gym

Wipe down kit once you have used it with the cleaning products provided. Cleaning stations and wipes are available in the gym for you to use

Not bring towels onto the gym floor, please use the wipes available instead

Not drink directly from the water fountain, this is to fill water bottles only

Failure to comply may result in you being asked to leave the gym.

Membership

During any time in which the gym is affected by illness our standard terms and conditions relating to membership cancellation and freezes will continue to stand. The gym will continue to provide service digitally, and through other various methods. These services will constitute the continuation of your membership payments.

Lone training
Good Health - it is important that you are fit to train. If you have any conditions or illness that might be a risk, it is best to get advice on how to exercise while staying safe.
Exercise knowledge- some equipment or exercises may be complex, especially the first time you try them. We have instructions on much of our equipment so take time to understand how to use them, and how to properly undertake any exercise. And of course, warm up, start with low weights and dont overexert yourself.
Support if you have questions on using the gym or the equipment, just ask for help. If one of the team arent to hand, ask another member. Theyre a friendly bunch and happy to help!
Know your gym- you never know when you may need to know your way around the gym, so get familiar with the layout, know where the emergency help points are (you will find them around the gym) and also where the emergency exits are. These are extra important if you train through the night and are on your own in the gym.
Seek Help if you ever feel unwell, injure yourself or are concerned for your wellbeing, get help! If our team arent on hand, call for another member or use one of the emergency help points. We always operate CCTV and will be able to support you and get help if you trigger the alarm.
Train with others where you can, training with friends is not just more fun, but youll have someone to watch your back. Of course, this may not be possible (especially if you train late at night or in the morning), so keeping other members close to hand in case you need some support is a simple alternative.

If I decide that I do not wish to undertake induction training I will seek advice from a member of staff if I am unfamiliar with a particular piece of equipment or type of exercise. Further I accept that I have opted out of the induction training in the knowledge that this is an UNSUPERVISED FITNESS CLUB and I undertake to consult staff on an ongoing basis in relation to the safe use of the Club's facilities and equipment. I acknowledge that this is at times an UNSUPERVISED FITNESS CLUB and I assume all risks associated with using exercise equipment and exercising alone without the aide and presence of club staff on the premises.

Member Rules on Safety & Hygiene.

By visiting Fitness Space you are agreeing to the following rules
You must:

Make yourself familiar with all safety and cleaning procedures. Failure to follow these may result in a temporary or permanent ban from the gym

Not visit the gym if you are showing any symptoms of Covid-19 or live with anyone showing symptoms or who has the virus

Follow the social distancing guidelines at all times while in the gym

Wash or sanitise your hands thoroughly on entering the gym and regularly while in the gym

Wipe down kit once you have used it with the cleaning products provided. Cleaning stations and wipes are available in the gym for you to use

Not bring towels onto the gym floor, please use the wipes available instead

Not drink directly from the water fountain, this is to fill water bottles only

Failure to comply may result in you being asked to leave the gym.

Membership

During any time in which the gym is affected by illness our standard terms and conditions relating to membership cancellation and freezes will continue to stand. The gym will continue to provide service digitally, and through other various methods. These services will constitute the continuation of your membership payments.

Lone Training

Good Health - it is important that you are fit to train. If you have any conditions or illness that might be a risk, it is best to get advice on how to exercise while staying safe.
Exercise knowledge some equipment or exercises may be complex, especially the first time you try them. We have instructions on much of our equipment so take time to understand how to use them, and how to properly undertake any exercise. And of course, warm up, start with low weights and dont overexert yourself.
Support if you have questions on using the gym or the equipment, just ask for help. If one of the team arent to hand, ask another member. Theyre a friendly bunch and happy to help!
Know your gym you never know when you may need to know your way around the gym, so get familiar with the layout, know where the emergency help points are (you will find them around the gym) and also where the emergency exits are. These are extra important if you train through the night and are on your own in the gym.
Seek Help if you ever feel unwell, injure yourself or are concerned for your wellbeing, get help! If our team arent on hand, call for another member or use one of the emergency help points. We always operate a manned CCTV who will be able to support you and get help if you need it.
Train with others where you can, training with friends is not just more fun, but youll have someone to watch your back. Of course, this may not be possible (especially if you train late at night or in the morning), so keeping other members close to hand in case you need some support is a simple alternative.
